Darul Uloom Deoband issues anti-India fatwa promoting Ghazwa-e-Hind; NCPCR initiates action

Darul Uloom Deoband has hit headlines for controversial fatwas. In yet another such instance, Darul Uloom has issued a fatwa promoting the concept of Ghazwa-e-Hind, a concept which validates the invasion of India. The madrasa has said that those who sacrifice their during the invasion of India will be called great martyrs and that they will get to Jannat (heaven). Taking action against this, the National Commission for Protection of Child Rights has filed a complaint against this fatwa and sought FIR in this case.

On the Darul Uloom Deoband's website, a person asked a question, "My question is, does the hadith mention the invasion of India (Ghazwa-e-Hind), which will take place in the subcontinent? And whoever will be martyred in it is a great martyr. And the one who will be Ghazi (warrior) will go to heaven (will be Jananti)? Please reply."

Responding to this question, the madrasa said, "In the Name of Allah, the Most Beneficent, the Most Merciful. In the famous book Sunan al-Nasa’i of Sahaah Sita, Imam al-Nasa’i has made a permanent chapter: Ghazwa al-Hind, under which he has narrated a hadith from Hazrat Abu Hurairah (RA): The Messenger of Allah peace be upon him promised that we would invade India. If I live to see that I will sacrifice myself and my wealth. If I am killed, I will be one of the best of the martyrs, and if I come back, I will be Abu Hurayrah al- Muharrar (the one freed from the fire) (Vol: 2, p: 63), published by Mukhtar and Company, Deoband. This same invasion of India (Ghazwa-e-Hind) was prophesied by the Messenger of Allah (peace and blessings of Allah be upon him). And Allah knows best".

NCPCR takes action


Taking suo motu cognisance of the matter, the NCPCR has issued a notice to the District Magistrate (DM) and Superintendent of Police (SP) of Saharanpur district, directing them to file an FIR in this matter. It said that Darul Uloom Deoband is imparting anti-India teachings to children in Madrasas, promoting Islamic fundamentalism, thereby violating Section 75 of the Juvenile Justice Act.

Acting on its own accord under Section 13(1) TJ of the CPCR Act, the NCPCR expressed concerns that such fatwas could potentially incite hatred against the country. It has called upon the district administration to investigate the content on Darul Uloom's website, emphasising the need to block it immediately to prevent any further misleading of the public.

Furthermore, the NCPCR has cautioned that if prompt action is not taken, the district administration would be equally responsible for the potential repercussions of such teachings.

Expressing concern Priyank Kanungo, the National President of NCPCR said, "At Darul Uloom Deoband, children are being taught how to perform ‘Ghazwa-e-Hind.’ Whoever gives his life for Ghazwa-e-Hind will be called the supreme sacrificer. This organisation operates madrassas throughout South Asia. It is very dangerous to incite children to attack India in this way. In this matter, we have asked the district administration to register a case under sections of treason".
 
 
The NCPCR chief Priyank Kanoongo also noted that such fatwas were issued by the Darul Uloom Deoband in the past as well and urged them to take action against it, too. He said in the notice, "Earlier in January 2022 and July 2023, Commission had brought to the attention of District Administration that there is a large number of fatwas on Darul Uloom Deoband’s website that mislead the public and had requested to thoroughly examine, investigate this organization’s website and any such website be immediately blocked. It was also requested to block access to the website. However, the District Administration has not yet taken action on the same and has not lodged any FIR in the matter."
