Amidst a galore of hate speeches & anti-Sanatana dharma tirades by DMK party Youth Secy Udhaynidhi Stalin, Legal Rights Observatory (LRO) Monday issued a legal notice to Chennai Police for suo motu registering an FIR against Udhayanidhi Stalin, Tamil Nadu’s minister for youth and sports affairs and son of chief minister MK Stalin for delivering “hate speech” targeting the followers of Sanatan Dharma.

Legal Rights Observatory has earlier informed about instructing senior lawyer Advocate Umesh Sharma to issue notice to Chennai Police, to register an FIR against the minister Udhayanidhi as per SC guidelines on hate speech.


Now in the latest development, Sr Lawyer Adv Umesh Sharma has issued a 7-day legal notice to the Chennai Police commissioner to arrest Udhaynidhi Stalin U/s 295A,153A,298,505 IPC & CrPC.


As per sources, even Chennai Police can be dragged to the Supreme Court if it denies/fails to act against Udhaynidhi Stalin under grounds of “Contempt of court” proceedings because of directions issued by Hon’ble Supreme court in hate speech case in Shaheen Abdulla verses Union of India & Ors.





The Snippet of the order passed by Hon’ble Supreme court is mentioned below :

This Hon’ble Court was pleased to issue notice in the instant Writ Petition vide order dated 21.10.2022 and passed the following order:
 
“When any speech or any action takes place which attracts offences such as Sections 153A, 153B and 295A and 505 of the IPC, etc., suo moto action will be taken to register cases even if no complaint is forthcoming and proceed against the offenders in accordance with law. therefore issue direction(s) to their subordinates so that appropriate action in law will be taken at the earliest. We make it clear that any hesitation to act in accordance with this direction will be viewed as contempt of this Court and appropriate action will be taken against the erring officers.

We further make it clear that such action will be taken irrespective of the religion that the maker of the speech or the person who commits such act belongs to, so that the secular character of Bharat as is envisaged by the Preamble, is preserved and protected.”

In another latest development TN BJP Secy A. Ashvathaman has sought permission from TN Governor RN Ravi to prosecute DMK’s Youth Secy Udhayanidhi Stalin u/s IPC 153, 153A, 295, 295A, 296, 298, 499, 504, 505 for his obnoxious statement against Sanatan Dharma.
