Mumbai, July 20: Supreme Court on Wednesday heard pleas relating to rebellion in Shiv Sena and said that some matters in the Uddhav-Shinde legal battle may go to a larger bench.
The Apex Court posted the matter for hearing on August 1 as the Uddhav Thackeray camp sought a status quo to be maintained while the Shinde side slammed the ex-Maharashtra chief minister for not being able to gather the support of even 20 MLAs.
The bench, led by CJI NV Ramana, asked both Thackeray and Shinde factions to frame issues they wanted to argue, make one compilation and submit it preferably by next Wednesday. The Supreme Court bench also asked the respondents to file a common affidavit if they want to deny any allegations.
Disqualification proceedings, the election of Speaker, recognition of the whip and floor test among other issues are the subject matters of the dispute.
During the court hearing, Kapil Sibal, who was appearing for the Uddhav Thackeray side, sough that a status quo be maintained, saying that “no faction should be hurt".
Meanwhile, the Shinde side, snubbed ex-Maharashtra chief minister Uddhav Thackeray as a “man who can’t gather the support of 20 MLAs".
Sena’s parliamentary party split on Tuesday, days after the split in Maharashtra assembly, with 12 of its 19 Lok Sabha members shifting allegiance to Chief Minister Eknath Shinde and declaring two-term member Rahul Shewale as their leader in the Lower House.
Rahul Shewale, the leader of the rebel faction of the Shiv Sena, claimed that they have aligned with the BJP as per wishes of Thackeray, who was himself making similar efforts in June 2021 but backtracked later. But the claim was rubbished by Thackeray faction.
The next hearing in the Sena vs Sena legal battle will happen on August 1.
