'सत्यमेव जयते!' Delhi court sentences death penalty to Ariz Khan in Batla House encounter case

New Delhi, March 16: Serving justice to the Delhi police inspector Mohan Chand Sharma, the Delhi court awarded the death penalty to convict Batla House terrorists Ariz Khan for killing inspector Mohan Chand Sharma in the 2008 Batla House encounter. Additional Sessions Judge Sandeep Yadav categorised the killing of Insp MC Sharma as "Rarest of rare case''.

Additional Sessions Yadav pronounced the order on the sentencing of the convict in the open Court. The court observed that the convict on account of his despicable act has forfeited his right to live. After balancing mitigating circumstances against aggravating circumstances, it is concluded that it is the rarest of the rare case where the convict deserves the maximum sentence provided under the law. It is the level of magnitude, degree of brutality, attitude, and mindset of the wrongdoer behind the crime along with other factors which makes it a rarest of rare case.

The Court added, "Protection of society and deterring criminal is an avowed object of law and this is required to be achieved by imprisonment appropriate sentence. The most appropriate sentence for a convict like Ariz Khan will be the death penalty. The interest of justice will be met if the convict is awarded the death penalty."
 
The court also slapped a fine of Rs 11 lakh against Khan. It has directed that out of the penalty amount Rs 10 lakh should be given to the family of Sharma as compensation. It also recommended additional compensation from the government to the family of the deceased police officer. The Court convicted Ariz Khan under sec. 186, 333, 353, 302, 307, 174A , 34 of IPC and 27 of Arms Act.
 
The same court has pronounced Ariz Khan guilty on March 8, asserting that the prosecution has successfully proved the case.
 
 
The court's ordered has given a huge setback to the Save Batla House terrorist conspiracy lobby. It is a tight slap on the face of ‘secular’ leaders who had termed these encounters as fake and had blamed the Delhi Police for hurting Muslims.
 
On the fateful day of 19th September 2008, two Indian Mujahideen terrorists namelyAtif Ameen and Mohd Sajid were killed during the encounter. The said encounter also claimed the life of Delhi Police Inspector Mohan Chand Sharma who succumbed to the bullet injuries sustained in the gunfight. On receiving the tip, a Delhi Police's Special Cell team reached flat no. 108 of L-18 Batla House headed by Inspector Mohan Chand Sharma who was later shot by one of the accused persons.
