Bar Council suspends advocate Malik for using chambers for religious conversion

New Delhi, July 06: In the major development, the Bar Council of Delhi on Monday suspended the license of advocate Iqbal Malik for using his chambers to perform religious conversions and Nikah in the Patiala House Court.
 
The court took the action days after a man filed a complaint against advocate Malik alleging that he has been using chambers at the Karkardooma Courts complex for 'anti-social and illegal activities. The man also alleged that a conversion trust is being run from the chambers of the advocate and his daughter was forcefully converted as Muslim.

Following the complaint, BCD Ramesh Gupta suspended Malik's license and directed him to file his reply before the special Discilinary Committee within 7 days. The BCD also asked him to appear before the committee on 16 July. The BCD further warned him that if he gets failed to appear before the court on 16 July the court may committee may proceed ex parte and take further appropriate action against him.

BCD also observed that such conduct 'negates the dignity of the legal profession.' The BCD further also sought Delhi Police's help to provide all necessary information in the case to the Disciplinary Committee. BSC has further formed a three-member Special Disciplinary Committee which will be investigating the entire matter and coming up with the decision within three months.

" Ramesh Gupta Chairman while considering the gravity of the issue and upholding the dignity and honor of the legal fraternity, exercised his special powers conferred under Rule 43 of the Bar Council of India Rules and Section 6 (1) (d) of the Advocates Act, 1961, referred the issue to the Special Disciplinary Committee and as an interim measure, considers it necessary and appropriate to suspend your license to practice until the finding and conclusion by the Disciplinary Committee., The resolution reads.
 
 
It states further, “Looking into the averments in the complaint and the documents, prima-facie the activities of performing the Nikah in the Chamber/ Court premises cannot be permitted by an advocate or any other person, as such it calls for an urgent action by the Bar Council.”
