New Delhi, December 23: Delhi High Court, said that it will hear actor Juhi Chawla’s plea, challenging the single bench order which had dismissed a lawsuit filed against the setting up of 5G wireless networks in India on January 25, 2022. The Division Bench of Justice Vipin Sanghi and Justice Jasmeet Singh, adjourned this matter for January 25, 2022.
Justice Sanghi said, “Today our board is very heavy, hearing in the matter will take time.” Juhi Chawla stated in her appeal that the single bench order dismissing the suit is bad in law as a suit can only be dismissed once it has been allowed to be registered as a suit by Court. She further stated that the single bench imposed costs on her even after plaint had not been permitted by him to make sure into a 'suit', and acting without jurisdiction, contrary to law.
She also challenged the single judge’s finding that this motion was preferred only to gain publicity, whose motive was inferred by learned single judge, just from the fact that Plaintiff had circulated this video-conferencing link of High Court on her social media accounts which had resulted in repeated disruption of the Court proceedings held on June 4, 2021. Single Bench of Justice JR Midha had dismissed this lawsuit filed by Chawla, against the setting up of 5G wireless networks in India.
The bench of Justice JR Midha while passing the judgement, said that Plaintiffs abused the process of law and imposed costs of Rs 20 lakh on plaintiffs.
Back in August, Juhi talked about the court dismissing her lawsuit. In a video, she wrote, “It was about time. I'll let you decide if it was a publicity stunt.” In the video, she spoke about how she approached various organisations, parliamentary committees about the issue. She also said she saw a news report about harmful effects of cellular radiation on human health and decided to call up agencies who could help her find out if she and her family were affected by radiation from cell towers also.

In the bigger picture, 5G is not only fast, but also highly relevant. 5G will act as the socio-economic multiplier of the country and it is expected that India will clock second-highest global consumption of mobile data per month by 2027, that’ll be 50GB per month on average, up from a monthly average of 12GB in 2021. India will play a crucial role amongst the APAC countries, along with Japan, South Korea, Singapore, and China, in the next few years.
