New Delhi, August 19: A big relief to the Sushant Singh's Family came as Supreme Court on Wednesday gave nod for the CBI probe in the Sushant Singh Rajput death case. It has also directed the Maharashtra government to cooperate with the CBI during the investigation.
The orders were dictated within minutes of the single-judge bench assembling. The judgment was passed by a Single Judge Bench of Justice Hrishikesh Roy. The Court also directed the CBI to look into any other cases registered in the future in relation to the death of Rajput.
The top court clearly said that the FIR registered at Patna was correct and adhered to the principles of the Criminal Procedure Code. Therefore, the court added, the recommendation made by the Bihar government for a CBI investigation was also proper and valid.
The SC further slammed Mumbai Police saying that the inquiry conducted under Section 174 of CrPC "is not an investigation," it just was "Inquiry." Reading out the operative part of the 35-page judgment, Justice Roy also said that Maharashtra government must comply with the orders since it is a court-ordered probe.
This is the fourth hearing in the Sushant Singh Rajput death case. In the first hearing on August 5, the Centre had told SC that they have accepted the recommendation of the Bihar government to transfer the case to the CBI. The apex court had, in its last hearing on August 11, reserved its judgment and asked all the parties to file their respective submissions in the case.
"This is a victory for Sushant Singh Rajput's family. SC ruled on all points in our favor. The Court also clearly said that the FIR registered at Patna was correct" Vikas Singh, Lawyer of Sushant Singh Rajput's father said. He also adds that SC also said that any other FIR registered in connection with the Sushant Singh Rajput's death will also be investigated by the CBI. We hope that we should get justice very soon. The family is very happy with the verdict.
CBI has already formed a team to probe. The CBI has also registered an FIR against Rhea Chakraborty and her family in connection with Sushant's death after the Centre accepted the Bihar government's recommendation to transfer the probe in the matter from Patna. The CBI is also taken statements from SSR's father and sister. The CBI is likely to arrive in Mumbai to begin its probe.
Moreover, Mumbai Police have questioned 56 persons, including Bollywood biggies such as Aditya Chopra, Mahesh Bhatt, Sanjay Leela Bhansali, film critic Rajeev Masan in connection with Sushant's death case.
After the order was pronounced, Maharashtra government counsel said, "We have only filed a transfer petition. Not challenged the CBI investigation. Our right to challenge the order should be taken into consideration." However, the request has been rejected by the Supreme Court. Now, there is no scope for the Maharashtra government to challenge the order.
It comes after Rajput’s father KK Singh’s complaint that Rhea Chakraborty was responsible for abetment of his son’s suicide, Patna Police registered an FIR on July 25. Singh also alleged that Chakraborty illegally transferred Rs 15 crore from Rajput’s bank account. After that Rhea Chakraborty had filed a plea seeking transfer of an FIR filed against her in the late Bollywood actor's death case from Bihar to Maharashtra.
Sushant's family has been demanding CBI probe in the matter for many days and had even organised a global prayer meeting seeking support from fans and well-wishers of the actor to join hands in the battle for Sushant Singh Rajput. Following the apex court’s verdict, Sushant's sister Shweta tweeted, "Thank you, God! You have answered our prayers!! But it is just the beginning... the first step towards the truth! Full faith on CBI!! #Victoryoffaith #GlobalPrayersForSSR #Wearefamily #CBITakesOver."
