Mumbai, November 23: A day after recovering 86.5 grams of ganja from Bharti Singh and her husband's house during the raid, Mumbai Court has now sent the duo in judicial custody till December 4.
Moreover, the court refused to give the couple's custody to NCB citing that it was only a case of consumption. This comes after Defence lawyer Ayaz Khan argued that there is no question of custodial interrogation as the alleged substance recovered is lesser than the ‘small quantity’ as prescribed under the Narcotic Drugs and Psychotropic Substances (NDPS) Act.
Singh and Limbachiya have been booked under sections 20(b)(ii)(A) (involves the small quantity of drugs) and 8(c) (possession of drugs) and 27 (consumption of drugs) of the NDPS Act.
As per the court's order, Bharti is lodged at the Byculla women's prison, the same place where actress Rhea Chakraborty was held. Whereas, her husband Haarsh has been sent to Taloja jail. They have filed for bail and it will be heard by the Esplanade Court, Mumbai on Monday.
The couple was arrested by the Narcotics Control Bureau on Saturday after they recover drugs from their house during the raid which was conducted on Saturday. As per the NCB, They recovered a bag with 65 grams of ganja. Later, another search was carried out at his residence, Oberoi Springs in Andheri, from where another bag consisting of 21.5 gram of cannabis and unaccounted cash of Rs 1.49 lakh were seized
While speaking about the case, an NCB official informed that the duo had admitted to the consumption of Ganja. Singh had reportedly stated that Haarsh procured the drug for her from one peddler and kept two bags (one at the office while the other at his residence) for consumption.
